Update on Baby Vanessa’s Birthfather who is Fighting for her Custody
Baby Vanessa was adopted by Stacey Doss at birth and now the birthfather is contesting the adoption. Vanessa was to be returned to Ohio from her home with Stacey Doss in California but Doss managed to get a temporary emergency stay order so her daughter would not be placed in foster care in Ohio while the battle over custody ensues.
The birthfather, an unsavory character who has spent time in prison for domestic violence and also has an open case of child endangerment filed against him (he has four other biological children but has custody of none), apparently was harassing Vanessa’s birthmother, Andrea Conley at a bus stop. Conley supports the adoption of her daughter Vanessa by Stacey Doss and has filed a petition for a domestic violence civil protection order against Benjamin Mills, Jr.

Our GuestBlogger today is David Archuletta, the father of a wrongfully adopted son. His son was placed for adoption by his girlfriend; he was told that the baby was stillborn and not his. The child was his and now David is devoted to adoption reform in the U.S. He has published a book: "Odyssey of an Unknown Father: The Complete Book on Wrongful Adoption." To date he has yet to see his child.

In analogy, the Library of Congress is a brick and mortar structure built on a foundation of knowledge formed through the perseverance of those that seek such knowledge. However, although well-schooled, we are still yet but imperfect human beings. That said, even in these hallowed halls, sometimes we can run across wrongly applied determinations. Moreover, although these oversights are published by an authority perspective to each field of expertise, when found, shouldn’t we correct these wrongs? In my opinion, this should be done regardless if the error found by a common layperson such as myself.
In the Library of Congress Subject Heading department there is a newly recognized term. It is “Wrongful Adoption,” and it cites definition as follows:

Can a Birth Parent Take Back Their Stolen Child From the Adoptive Parents? Dutch Court Says NO.
What happens when a birth parent discovers the whereabouts of their stolen child? Can they see that child or bring that child back home? A couple from India tried to do just that. They saved their money and travelled to Holland hoping to prove that a 12 year old Dutch boy was actually their son who had been stolen from them 11 years ago. But a family court in Holland turned down their request for a DNA test ruling that this could cause too much emotional damage to the child. Apparently this Indian couple are one of many who have had their children stolen from them and placed for adoption.
Adoption is a far better fate than most other stolen Indian children faced:
According to Bachpan Bachao Andolan, or Save Childhood Movement, an Indian child-rights non-governmental organisation, 45,000 children go missing in India every year. Most of the lost children end up as prostitutes, bonded labourers or among the homeless population in big cities. Some of the missing children land in orphanages, and a percentage of those reach their adoptive families in India and abroad.
But back to the issue at hand, did the Dutch court make the correct decision? Should the DNA test have been allowed?

Ethical Adoption from Ethiopia
With the increase in the number of children being adopted from Ethiopia in the last few years (2009-- 2,277; 2008 – 1725; 2007 -1255; 2006- 732), there have been more reports of unethical practices and irregularities in some of these adoptions. There are of course ethical adoptions from Ethiopia, probably a large majority of them, but of course no adoption system is perfect and inconsistencies are quickly picked up by the media. At this point in time, Ethiopian adoptions are growing at a faster rate than any other country.
Ethiopia is not party to the Hague Adoption Convention and due to concerns of corruption and child trafficking in Ethiopian adoptions, the U. S. Embassy in Addis Ababa has implemented some changes.
Adoptive parents should be aware that an I-604 (Determination on Child for Adoption, sometimes referred to as “orphan investigation”) must be completed in connection with every I-600 application. Depending on the circumstances of the case, this investigation may take up to several weeks or even months to complete. Therefore, adoptive parents should not plan to travel to Ethiopia until they have confirmed with their adoption agency that their visa interview appointment has been confirmed.

Birthfather Still Fighting to Get His Daughter Back
Over a year ago, John Wyatt of Virginia became a father, but he has yet to hold his daughter in his arms. When his girlfriend became pregnant he declared his interest in raising the child. His girlfriend talked about adoption but he was opposed. She didn’t call him when she went into labor, and when he got suspicious raced to the hospital only to find that both mother and daughter had already checked out.
Apparently his daughter, born on 2/10/2009, was already being placed for adoption with a couple from Utah. Wyatt was too late, resulting in a battle between lawmakers in Utah and Virginia regarding the fate of baby Emma. In December (’09) a Stafford County (Virginia) judge awarded Wyatt custody of his daughter because he had sought custody five days before the adoptive couple filed adoption papers in Utah. The judge cited a kidnapping and ordered the state to bring Emma back from Utah. But officials in Virginia claim they lack the legal authority to follow the judge’s order.

Russia Should do More Than Suspend Adoptions
Russia has suspended all pending adoptions in response to one American adoptive parent’s decision to send her adopted child back to Russia claiming that he was severely psychologically damaged. This response from Russia was expected and frankly I think it is the right decision at this point. Russia is outraged that no charges have been filed against the mother for “disadopting” her child in this manner. To date, we’ve heard nothing from the mother, who obviously did her homework when it came to finding a way to send her adopted son back to Russia and have someone pick him up when he arrived. The fact that she has not been charged points to a strong possibility that she spoke to a lawyer and found some loop hole that would allow her to “disadopt” her son without facing any repercussions from the law (to date.)
I agree with Russia’s outrage at this horrendously irresponsible behavior on the part of this adoptive mother but I also think it is high time that Russia addressed two serious issues in their country that are related to this incident:
1.The high number of children born with Fetal Alcohol Syndrome (FAS)in Russia. FAS causes stunted growth, facial deformity, neurological deficits including low IQ, learning disabilities and vision and hearing problems and serious behavioral problems. There are even more children with neurological and behavioral problems that fall under the fetal alcohol syndrome spectrum that do not have the physical features.
Parents - Walk Walk and Walk a Little More
As parents we need to be physically and mentally on top of our game. This is particularly important for older parents. So how do we go about doing this? Should we join yet another gym we will probably avoid like the plague after a month or so? Would doing Sudoku and crossword puzzles every day be beneficial?
Well it so happens that walking is the answer to both keeping our brain and our body in good shape. According to the AARP:
“Simple forms of steady exercise, such as walking, give you the best mental boost. Walking improves your ability to make decisions, solve problems, and focus. Even small doses of walking, like a 15-minute trek, can increase your brain power.”

This is the true story describing the practices employed by one Rosie O'Donnell funded Children of the World Adoption Agency [COWAA]. It 'was' located in Verona, New Jersey; this agency's doors have remained self-closed since May of 2007. It is also from within these walls where plots were conceived and masqueraded in the workings of a real adoption agency. As for the reasons for the closing of this agency, there remains the dark history of a corporate suicide! Had someone revealed this company's blueprint for wrongful adoption?
It was me that forced the State Attorney General Office to lean heavily on an already suspect New Jersey Department of Human Services. They in turn, were instructed to render unto COWAA a take it or leave it proposition for the Board of Trustees. That thought withstanding, and whilst all faces were longer than the table at which they sat, it must have been the Chairwoman of the Board, a Mrs. Margaret Morrisey, who probably thought it better to reserve the company a more preferable choice-spot in hell!
GUESTBLOG: Just for the Record - Open Birth Certificates

From an adoptee overseas when I asked her if biological parents ever harass adoptees… “Yes it does happen, It is just from what point you see it. With international adoptees you have this more, because once they have found each other, bio families believe the child is still a member from the family like anyone else from the family. So they have these expertations that their children will help them financially. It is more a financial issue. I know one boy he found his mother and she wanted to have sex with him in a very aggressive way. So that can also be an issue.
Some facts about states with Open Birth Certificates: There are 6 states in our country where adopted men and women can request and receive their obc‘s upon written request and without any compromise or restrictions.
1. KANSAS – This state never got around to sealing adoptee’s records. Adopted adults from Kansas have been able to get their obcs in the same manner as non-adopted folks for over 50 years now.
2. ALASKA – This state also never sealed its adoption records. Adoptees here have been able to freely access their obcs for over 20 years.
3. OREGON -. From June 2000 through November 2007, 9,571 adoptees sought and received their birth certificates in Oregon.
4. ALABAMA - which began releasing records in August 2000, filled 4,186 requests through November 2007.
5. NEW HAMPSHIRE - which began releasing records in 2005, issued 1,056 obcs through 2007.
6. MAINE’s access law was just enacted on January 1, 2009. Three months into the new law and 542 requests for original birth certificates had been received and obcs issued.
Having Your Cake and Eating it Too? Continuing in Infertility Treatment While Applying to Adopt
Sitting as I do with one foot in the infertility world and one foot in the adoption world, a question I hear a lot from people is whether they have to stop infertility treatment before they can apply to adopt. I suspect adoption agencies and social workers don’t hear this question as much since most people aren’t comfortable asking them this question. Quite frankly, it is a bit of a sensitive hot topic in adoption circles.
Over the years (Gulp, that sure makes me sound old!), I have talked with many adoption experts and therapists about this question, and there is disagreement about the advisability of continuing to pursue infertility treatment and adoption at the same time. Those that oppose pursuing both are concerned that on some level (perhaps unconsciously) you will consider adoption second best. They view continuing treatment as a red flag that you have not come to terms with your infertility losses and may have trouble bonding with your adopted child. The financial drain of pursuing both may also put undue stress on the family. Others do not think pursuing infertility treatment and adoption are mutually exclusive and that it is possible to pursue both without lessening your commitment to either.
